Background

Public notice is required for certain types of development proposals. For example, when a property is proposed for subdivision (such as a short subdivision) a public comment period is part of the review process. Comments submitted during the official comment period are considered as part of the project review and become part of the official project record. Individuals who submit comments or request to stay informed are considered "Parties of Interest" and will receive notice of the City’s final decision. To be included in the official record, comments must be received within the designated comment period. While staff will respond to questions received after the comment period has closed, those comments are not entered into the record. Comments received during the comment period are also shared with the applicant.

When required, public notice is issued in several formats, including mailed notices to property owners within 1,000 feet of the site, publication in the Seattle Times newspaper, on-site posting, and notification on the City’s website.

When is Notice Required?

Land use decisions are categorized as Types 1 through 5, depending on the level of discretion involved. These classifications are detailed in Kenmore Municipal Code (KMC) 19.25.020.

Type 1

No

Administrative decisions made by the City. These are not appealable and do not require public comment. Common examples include right-of-way permits, building permits, demolition permits, engineering permits, and boundary line adjustments. See KMC 19.25.020 for a complete list.

Type 2

Yes

Administrative decisions by the City that may be appealed to the Hearing Examiner. These require a public comment and appeal period. Common examples include short plats and conditional use permits. See 19.25.020 for a complete list.

Type 3

Yes

Public hearing and recommendation by the City, followed by a decision by the Hearing Examiner. Common examples include long plats and special use permits. See 19.25.020 for a complete list.

Type 4

Yes

City recommendation, a public hearing with the Hearing Examiner, and a final decision by the City Council. 

Type 5

Yes

Public hearing and recommendation by the Planning Commission, followed by a final decision by the City Council.

Please note that mailed comments must be received (not just postmarked) before the deadline.

Information for Applicants

Applicants are responsible for posting the public notice board at the project site, maintaining its condition, keeping it stocked, and submitting an affidavit of posting. The board must remain up through the comment and appeal periods. Boards have strict deadlines; posting late may delay the project and result in additional costs. The City will provide detailed instructions once the application is submitted and before the notice period begins.
